Terms and Conditions of Use for the Citizen Ticketing System

1. About the Application

The integrated Citizens Portal platform (tickets.gheorgheni.ro) is a web platform developed within the project "Development and Implementation of an Integrated Information System at the Municipality of Gheorgheni". The platform provides citizens with a series of electronic services that electronically process citizens' requests to departments within the Municipality of Gheorgheni, being available to all users of electronic devices with internet access.

2. Acceptance of Terms of Use

By using the Ticketing System you accept these Terms and Conditions of Use. The Municipality of Gheorgheni may modify these Terms and Conditions at any time in order to improve the service. By continuing to use the Ticketing System after changes are made to these Terms and Conditions, you agree to accept those changes.

3. Purpose of the Platform and Request for Personal Data

The Ticketing System will provide a new, modern and fast communication channel between citizens and various departments within the Municipality of Gheorgheni in order to improve the quality of their services. Therefore, it is essential to identify as accurately as possible the details of the submitted request and the person transmitting the information.

Two types of data falling under personal data can be identified:

• Application access data, necessary for correct user identification - name, surname, email, phone
• Data collected through form completion, such as: identification data Address, ID, CNP/CUI, Field of activity, Characteristics, details regarding privately owned property, files in various formats that can be added within applications

The user will acknowledge the nature of the requested data when using the application.

4. Data Users

The users of the information and data received are departments within the municipality for the purpose of correctly identifying the problem as well as appropriately resolving the submitted request.

5. Data Retention

We retain your personal data for the period necessary for the purpose for which we initially requested it, including for the purpose of creating an archive, in order to improve the quality of local services.

6. Application Usage Limitations and User Categories

The Ticketing System is intended for persons who have reached the age of 18, who have the knowledge and ability to use electronic devices and who assume responsibility for the accuracy and validity of the details completed in the request. Sending erroneous, malicious, or obscene messages may lead to suspension of access rights to the platform. Other categories of persons may use traditional methods of contact with municipal departments.

7. Confidentiality and Personal Data Security

In accordance with EU Regulation 679/2016, the Municipality of Gheorgheni collects and processes personal data, respecting the principles mentioned below, for legitimate purposes, in accordance with the Terms and Conditions of Use of the Ticketing System which includes both public information sections and secured online interaction sections.

8. Obligations Regarding Personal Data Processing

As a personal data operator, the Municipality of Gheorgheni has the legal obligation to ensure:

• Storage or transfer of personal data only to local servers, within the European Union, or exclusively to service providers in the USA certified under the EU-US Privacy Shield;
• Inventory of personal data and exclusive collaboration with service providers who also comply with GDPR requirements;
• Keeping records of personal data processing activities;
• Security and confidentiality of personal data.

9. Your Rights Regarding Personal Data

As a personal data operator, the Municipality of Gheorgheni has the legal obligation to ensure data subjects can exercise their rights over personal data in accordance with the provisions of General Regulation (GDPR) 679/2016, art.15-22, the most important being:

• The right to information and access to personal data;
• The right to rectification;
• The right to erasure of data ("right to be forgotten");
• The right to object to data processing;
• The right to data portability;
• The right to object to automated decision-making processes;
• The right to lodge a complaint with the National Authority for Personal Data Processing Supervision.

You can exercise all these rights by sending a written request online to primaria@gheorgheni.ro and/or by phone to the number displayed on the municipality's website and/or to the postal address: Piața Libertății 27, 535500 Gheorgheni, Harghita County, Romania.

10. Intellectual Property

The Municipality of Gheorgheni and/or its licensors are the sole owners of the Ticketing System, which includes any software, domain and content made available through the application, website or Social Media pages. The Citizens Portal is protected by copyright laws in Romania.

11. Application Usage

By using the Ticketing System, you agree not to upload, post, email or transmit any material containing viruses or other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any software or hardware or telecommunications equipment associated with the Ticketing System.

12. Third Party Websites

The Ticketing System may contain links to websites/applications of third parties or programs that are not controlled by licensors or associated with the Portal. The Municipality of Gheorgheni is not responsible for the content, offers or privacy policies of such websites or programs.

13. Ticketing System Usage Costs

The Municipality of Gheorgheni provides the Ticketing System free of charge. The Municipality, through the Ticketing System, is not responsible for any additional costs when using electronic services.

14. Use of Provided Information

By accepting the Terms and Conditions of Use of the platform, you agree that the Citizens Portal may use any comments, attached photos, information or ideas contained in any communication you send to the Portal, without any compensation, acknowledgment or payment to you.

15. Warranty and Liability

The Municipality of Gheorgheni provides the Ticketing System as is and without any express, implied or statutory condition. The Municipality of Gheorgheni is not responsible for any errors or omissions occurring within the Ticketing System, any malfunction, delay or interruption occurring within the platform.

16. Complaints

By agreeing to these terms and conditions you agree that any claim, dispute or controversy between you and the Municipality of Gheorgheni, in connection with the Ticketing System, shall be submitted online and/or to the postal address Piața Libertății 27, 535500 Gheorgheni, Harghita County.

17. Use of Inappropriate Language

Any deviation from the platform's scope of activity, sending false requests, using obscene words, personal attacks, displaying advertisements or promotional messages, as well as making insults, will be sanctioned by partial censoring of the comment, complete deletion or even prohibition of the right to use the application.

18. General Provisions

If any provision contained in these Terms and Conditions of Use is deemed invalid or unenforceable, such provision shall be voided and the remaining provisions shall continue to apply.

19. Access Account

The platform is available to all citizens, users of electronic devices (computer, laptop, tablet, phone) who wish to benefit from municipal public services without traveling to the municipality's headquarters. Services are accessible only after creating a validated user account by completing all mandatory fields: name, surname, email address, phone.
